Council rejects sewer capacity request for Cross Creek apartments
A proposed 20-unit apartment complex behind Cross Creek Ranch appears unlikely after Malibu declined to allocate additional wastewater plant capacity.

Chances of a 20-unit apartment complex being built behind the Cross Creek Ranch shopping center appear very unlikely.
Last night, the Malibu City Council rejected a request from the developer to open the door for allocating sewage plant capacity for the residents.
City council members said the policy has been in effect for years: any landowner who wants to build more density than currently allowed has to make a deal with other property owners to transfer development rights to their land.
The issue is sewage plant capacity. Each vacant lot has been allocated a certain amount of sewage capacity at the city's Civic Center wastewater plant.
Developer advocate Don Schmitz has a client who wants to buy just a little bit more to accommodate a 20-unit apartment complex they want to build behind the Cross Creek Ranch shopping center.
No deal, said the city council. They told Schmitz to go out and find sewer capacity from the other vacant land owners.
The apartment complex would need, in addition to sewer capacity, all sorts of zoning changes and other city permissions in order to be built.
